This is not a complete listing of my services, just a “taster” so you can begin to understand how I can help. I do not do “pro-forma” solutions. All my efforts are geared at finding what is appropriate for you. My solutions are as individual as my clients. 1. Pre-Nuptial Agreements.
These provide the bed-rock for any divorce or separation settlement in many jurisdictions and in jurisdictions where they are not necessarily enforceable these can still provide very advantageous negotiating leverage to limit a spouse’s claims. It is still difficult for a spouse to argue that they should get more when at the start of the relationship they clearly agreed they would get less! With my extensive legal experience I can assist you draft and negotiate through to execution a “pre-nup’” that gives you unparalleled asset protection. Even more importantly I will guide you through the “soft-issues” that often are so hard; how to raise the subject with your partner; how to hold insistence softly without endangering the relationship and how to re-assure your partner that it is for their protection as well as yours. If you don’t have considerable wealth at present, but just know that you “have that big idea” that will mature into wealth at a later stage then you may still benefit from a pre-nup’ - but there are other solutions as well for such situations!
2. Asset Structuring
I can guide you through a re-structuring of your assets to minimise your exposure to divorce and taxes. Experienced in off-shore structures of all types I have the contacts and expertise to help you minimise risks and still control your assets from a distance, directly. As well as off-shore I can also assist with on-shore structures including Family Trusts and company structures.
3. Pre-divorce planning and Divorce Strategies
In my experience many spouses are caught off-guard when it comes to divorce. Either they think they will be OK because they have a naïve faith in the protection of the law and the justice system, or – if they are a little more worldly wise - they believe that if they have a good lawyer they will be protected against an unfair court division of assets in the case of divorce. Not so! In many cases your spouse is already planning and strategising for the end-game of divorce, sometimes with a lawyer already or sometimes not; in some cases they lay their plans over perhaps one, two or three years! Let us be honest. If you are reading this web-site it is because something in you “senses” that the day may come when things fall apart in your relationship; what makes you think your partner does not already have the same feeling? Divorce is just like any other enterprise where you must plan to get the result you want. I will assist you to come up with a strategic plan for the ultimate “rainy day”! I will guide you through all the “house-keeping” details you will not even think of but I know about because of my experience. Together we will arrive at a plan that you can work and that will protect you for the future.
4. Negotiation of financial settlements.
How often do you hear that a divorce was quite amicable – until the lawyers got involved! If only you could “do a deal” with your partner without lawyers’ interference! Well with my help you can! I am an experienced negotiator – after all it was my career for over 25 years! I will show you how and help you to negotiate with your partner without them even realising that you are doing so. I will analyse your asset position, point out to you what the probable level of court settlement is going to be and draft a plan with you for your negotiation and offer, usually including “fall-back” positions! I can guide you at every step of the discussions including telling you what to say – as well as what not to say! – and I will even draft the documents that you will present to your partner for signature. Yes, they will have to get independent legal advice before signature but by the time they are ready to do that you – and I in the background – will have them so committed to the agreed solution we have negotiated with them that there will be minimal impact from external legal advice.
5. General Matrimonial advice
Sometimes you need someone to get a new perspective from, not a friend but someone to give you a legally trained perspective but without formally going to a lawyer. Then I am the person to speak to. No-nonsense, practical advice from one who knows.
